Terms of Service - Intently

1. Agreement to Terms

By accessing or using Intently ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

Intently is operated by Wigley Studios ("we", "us", or "our"). These Terms govern your use of our dating platform, mobile applications, and related services.

2. Eligibility

To use Intently, you must:

Be at least 18 years of age
Be legally able to enter into a binding contract
Not be prohibited from using the Service under applicable laws
Not have been previously banned from the Service
Not be required to register as a sex offender

By creating an account, you represent and warrant that you meet all eligibility requirements.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Immediately notify us of any unauthorized access
Not share your account with others or transfer it

4. Acceptable Use

You agree NOT to:

Use the Service for any illegal purpose
Harass, abuse, or threaten other users
Post false, misleading, or deceptive content
Upload content that infringes intellectual property rights
Upload sexually explicit, violent, or harmful content
Impersonate another person or entity
Use automated means to access the Service
Attempt to circumvent security measures
Solicit money or engage in commercial activities
Post spam or unsolicited communications

5. User Content

You retain ownership of content you submit to Intently. However, by posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with operating and promoting the Service.

You are solely responsible for the content you post. We reserve the right to remove any content that violates these Terms or is otherwise objectionable.

5.1 Messages and Communications

By using Intently's messaging features, you acknowledge and agree that:

Messages may be reviewed by automated systems or authorized personnel for safety, moderation, and Terms enforcement
We may analyze messaging patterns and content to improve our Service, matching algorithms, and user experience
Anonymized message data may be used for research and product development
We may access message content to investigate reports of abuse, harassment, or Terms violations
Message content may be disclosed when required by law or to protect user safety

6. Subscriptions and Payments

Intently offers free and premium subscription options:

Premium: $14.99/month or $119.99/year
Elite: $29.99/month or $239.99/year

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Refunds are provided in accordance with applicable law. No refunds are issued for partial billing periods.

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method.

7. Safety and Interactions

While we strive to verify users, we cannot guarantee the identity or behavior of other users. You interact with other users at your own risk. We recommend:

Meeting in public places for first dates
Informing someone you trust about your plans
Not sharing financial information with matches
Reporting any suspicious or harmful behavior

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Wigley Studios and are protected by international copyright, trademark, and other intellectual property laws.

9. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.

You may delete your account at any time through the app settings. Upon deletion, your profile and content will be removed, though some information may be retained as required by law.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that you will find a compatible match.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIGLEY STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS.

Some jurisdictions do not allow certain limitations of liability. In such cases, liability is limited to the maximum extent permitted by applicable law.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in the State of Georgia, except where prohibited by law. You agree to waive your right to participate in class action lawsuits or class-wide arbitration against Wigley Studios.

For claims under $10,000, arbitration may be conducted entirely online. Nothing in this section prevents either party from seeking injunctive or equitable relief in court for matters relating to intellectual property or unauthorized access to the Service.

Chargebacks or fraudulent payment disputes may result in immediate account suspension.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.
